Spencer Thompson addresses " Eminent Domain"

Mr. Spencer Thompson, Kansas City Attorney and member of the Governor's task force, presented a synopsis of the Final Report and Recommendations to the Governor.  These recommendations should help the Missouri General Assembly grapple with this problem.  Mr. Thompson said that he hope this report would go a long way in helping the state curb abuses.  There are 18 recommendations from the task force to the governor. The Eminent Domain issue will become one of those priority pieces of legislation coming out of Jefferson City in 2006.
Mr. Thompson presented both sides of the issue, plus [in-pointing where most abuses occur.  He noted that Missouri is surrounded by eight different states, which forces  more completive & flexible  understanding for economic development. Importantly, acquiring farming land at will would be prohibited. Also, there is a legal process whereby land owners can appeal on a case-by-case basis. Both sides would be expected to negotiate for property in good faith.

Platte County Pachyderm Club First Thursday Issue: Eminent Domain

Mr. Spencer Thompson presented the current state policy about Eminent Domain: "Eminent Domain, Public vs. Private Use".

When "eminent domain" gained increased scrutiny following the U.S. Supreme Court’s decision in Kelo v. City of New London, Governor Blunt engaged a task force to study the use of doctrine of eminent domain in Missouri. Local Kansas City attorney, and Northland resident, Spencer Thompson was appointed by Governor Blunt to serve on this task force, which made a variety of wide-sweeping recommendations.

At First Thursday's meeting, Mr. Thompson addressed the sticking point of "blighted areas". He gave examples on both sides of the issue. He & Senator Charlie Shields, Senate Floor Majority Leader, dialoged about the complexity of eminent domain for Missouri residents such as state court involvement with judicial review, etc. The role of Missouri's General Assembly up coming session was questioned. As an important open disclosure for those in attendance, Mr. Thompson made available handouts of the formal report of task force findings and recommendations to the governor.
